LAHORE : Lahore High Court on Wednesday sought comments from the Secretary of the Election Commission of Pakistan on petition challenging schedule announced for holding bye-election on two provincial assembly seats from constituencies PP-243 and PP-245 of district Dera Ghazi Khan, Punjab.
Petitioner Shahid Pervez challenged in LHC schedule announced for bye-election from constituencies PP-243 and PP-245 of district Dera Ghazi Khan.
His counsel submitted issuing a notification on March 29, 2012 the ECP announced schedule for holding bye-election from said constituencies on May 7, 2012. He stated very short time was allowed for filing nomination papers, scrutiny of nomination papers, filing appeals and decision of appeals by election appellate tribunal. This deprived petitioner of his fundamental right to contest election.
Counsel argued ECP issued notification in violation of Sections 11(1)(d), 11(1)(e) of Representation of People s Act 1976 as well as Articles 4, 9, 14 and 25 of Constitution of 1973. He prayed to declare impugned ECP s notification as null and void.
Justice Umer Ata Bandial issued notice to Secretary ECP and directed him to file comments till April 10, 2012.
